Article 1 — Definitions
In these Terms & Conditions, the following terms shall have the following meanings:
- Sadaqah Kiosk
- The trading name under which Haddo Solutions, a sole proprietorship, offers products and services. Where “Sadaqah Kiosk” is used in these Terms & Conditions, this refers to Haddo Solutions.
- Customer
- The natural person, legal entity, organisation or business that orders a Sadaqah Kiosk.
- Consumer
- A natural person acting for purposes outside their trade, business, craft or profession.
- Kiosk
- The freestanding donation stand supplied by Sadaqah Kiosk, including the associated components and equipment.
- Agreement
- The agreement between Sadaqah Kiosk and the Customer relating to the supply of one or more kiosks.
- Custom Design
- A design specifically created or adapted for the Customer, including the use of the Customer's logo and design files supplied by the Customer.
- Design Panel
- The printed panel used on the Kiosk featuring the design created for the Customer. This panel is produced exclusively for that Customer and cannot be reused for another Customer.
Article 2 — Applicability
- These Terms & Conditions apply to all offers, orders, agreements and deliveries by Sadaqah Kiosk, unless otherwise agreed in writing.
- By placing an order, the Customer agrees to these Terms & Conditions.
- If the Customer is a Consumer, the provisions of these Terms & Conditions apply only to the extent that they do not conflict with mandatory consumer protection law.
Article 3 — Offers and Prices
- The current prices of the Sadaqah Kiosk are stated on the website. The prices stated on the website are leading.
- The sales prices as of September 2026 are:
- 1 kiosk: €550;
- 2 kiosks: €1,050;
- 3 kiosks: €1,500.
- The prices stated on the website include VAT.
- Delivery costs are not included in the stated sales prices, unless expressly stated otherwise. Any delivery costs will be calculated separately based on, among other things, the distance and circumstances of the delivery.
- Sadaqah Kiosk may provide a separate quotation for delivery upon request.
- If the Kiosk is equipped with a mobile internet connection, the additional costs stated on the website apply.
- Sadaqah Kiosk is not obliged to accept an order in the event of an obvious pricing or input error.
Article 4 — Application and Formation of the Agreement
- An application for a Sadaqah Kiosk, for example through the application form on the website, constitutes an application and does not automatically constitute a definitive order or Agreement.
- Sadaqah Kiosk reserves the right not to accept an application or order, without being required to provide a reason.
- An Agreement is only formed once Sadaqah Kiosk has confirmed the application in writing and any required deposit has been received, and once the required logo and, where applicable, the Customer's own design have been received and approved by Sadaqah Kiosk.
- Until the above conditions have been met, Sadaqah Kiosk is not obliged to commence production or delivery, and the applicant is not obliged to make the purchase.
- If Sadaqah Kiosk does not accept an application after an amount has already been paid, the amount already paid will be refunded, insofar as no Agreement has been formed.
Article 5 — Payment
- A 50% deposit is currently required for an order.
- The remaining 50% must be paid after delivery of the Kiosk, unless otherwise agreed in writing.
- Payment is currently made by bank transfer using the payment details provided by Sadaqah Kiosk.
- If a payment is not made on time, Sadaqah Kiosk may suspend performance of the Agreement to the extent permitted by law.
- The Customer will never be asked to pay more than 50% of the purchase price in advance.
Article 6 — Design and Customer-Supplied Materials
- Sadaqah Kiosk works with a standard design in which certain colours and texts can be adjusted.
- The Customer may also voluntarily provide a completely custom design.
- Providing the Customer's logo is mandatory.
- The Customer warrants that they are entitled to use the supplied logo, design, images, texts and other materials and to make them available to Sadaqah Kiosk.
- The Customer indemnifies Sadaqah Kiosk, to the extent permitted by law, against claims by third parties arising from materials supplied by the Customer where such materials infringe third-party rights attributable to the Customer.
- The final design of the Kiosk created for the Customer remains the property of the Customer, as do the logo, brand name and other materials supplied by the Customer.
- The underlying standard design, design elements, templates and other materials of Sadaqah Kiosk remain the property of Sadaqah Kiosk.
- The Customer grants Sadaqah Kiosk an irrevocable, non-exclusive and royalty-free right to use the final design, the Customer's logo and images of the supplied Kiosk in portfolio, website, social media and other marketing and promotional materials.
- Sadaqah Kiosk may state or show that a particular masjid, organisation or business uses a Sadaqah Kiosk.
- Sadaqah Kiosk will not publish confidential information of the Customer that is not necessary for the relevant marketing purpose.
Article 7 — Delivery
- The average delivery time is approximately two weeks.
- The stated delivery time is an average indication and is not a guaranteed delivery period, unless expressly agreed otherwise in writing.
- For Consumers, delivery will in any event take place within thirty days after the Agreement has been formed, unless a different period has been expressly agreed.
- After receipt of the required deposit, the order will be confirmed and, where possible, a delivery appointment will be arranged.
- If a delay occurs that affects the expected delivery, the Customer will be informed by email.
- Sadaqah Kiosk arranges delivery. An external carrier may be used to carry out the delivery.
- Sadaqah Kiosk will try to agree a suitable delivery time with the Customer in advance.
- By agreement, the Customer may collect the Kiosk themselves in Arnhem.
- If delivery cannot take place at the agreed time due to circumstances on the Customer's side, the parties may agree on an alternative solution. This may include the Customer collecting the Kiosk themselves.
- Any statutory rights of Consumers relating to delivery remain unaffected.
Article 8 — Ownership and Risk
- Ownership of the Kiosk passes to the Customer once the full purchase price has been paid, unless otherwise agreed in writing.
- The risk of loss or damage passes to the Customer when the Kiosk has been delivered, except to the extent that the law provides otherwise.
- After delivery, the Customer is responsible for appropriate, safe and dry placement and for normal and careful use of the Kiosk.
Article 9 — Warranty and Defects
- Sadaqah Kiosk provides a two-year warranty on the tablet, payment terminal, cables and charging equipment, starting from the date of delivery.
- The warranty applies to defects that are not the result of improper use or other circumstances attributable to the Customer.
- The warranty does not apply to damage caused by circumstances attributable to the Customer or user. This includes, but is not limited to:
- dropping or impact;
- water, moisture or liquid damage;
- damage caused by heat or prolonged exposure to direct sunlight;
- improper or incorrect use;
- insufficient maintenance;
- placement in an unsuitable environment, such as outdoors or in a damp room;
- modifications or repairs by unauthorised third parties;
- use other than for the purpose for which the Kiosk is intended.
- The Customer is responsible for regular maintenance and careful use of the Kiosk.
- In the event of a defect, Sadaqah Kiosk may ask the Customer to safely send the relevant device or component to Sadaqah Kiosk.
- Shipping costs relating to a warranty claim or statutory conformity claim will be borne by Sadaqah Kiosk. There will be no cost to the Customer.
- Sadaqah Kiosk will reasonably arrange for a defect covered by the applicable warranty to be repaired or the relevant component to be replaced.
- This warranty does not limit or exclude the statutory rights of Consumers relating to conformity or defects.
Article 10 — SumUp and Payment Processing
- An active SumUp account belonging to the Customer is required to use the payment terminal.
- The Customer is responsible for applying for, setting up and maintaining their own SumUp account.
- Sadaqah Kiosk is not a party to the agreement between the Customer and SumUp.
- SumUp's terms, rates, availability and services are the responsibility of SumUp.
- Sadaqah Kiosk does not charge any additional transaction fees on top of the costs charged by SumUp for payment processing.
- Sadaqah Kiosk cannot be held responsible for outages, changes, restrictions or termination of SumUp services insofar as these are outside the control of Sadaqah Kiosk.
Article 11 — Internet, Power, Placement and Safe Use
- The Customer is responsible for a suitable internet connection, unless otherwise agreed in writing.
- The standard version of the Kiosk uses Wi-Fi.
- If the Kiosk is equipped with a mobile internet connection, the additional costs referred to in Article 3 apply. These consist of a one-off amount and a monthly amount.
- The monthly amount is payable for as long as the mobile internet connection remains active.
- If the monthly amount is not paid, Sadaqah Kiosk may suspend or terminate the mobile internet connection. The Kiosk itself will remain usable via Wi-Fi in that case. Sadaqah Kiosk will not switch off the Kiosk or restrict its operation.
- The Customer may terminate the mobile internet connection by notifying Sadaqah Kiosk in writing. The connection will then be deactivated at the end of the current month. The Kiosk will remain usable via Wi-Fi afterwards.
- The Customer is responsible for a suitable power supply and for connecting and using the Kiosk in accordance with the instructions provided.
- The Customer is responsible for safe and suitable placement of the Kiosk.
- The Kiosk is intended exclusively for indoor use. The Customer must not place the Kiosk outdoors or in a location where it may be exposed to rain, splashing water or high humidity, such as in or directly next to a washing area or wudu area.
- The Customer must not place the Kiosk in direct sunlight or near a heat source. Prolonged exposure to sunlight or heat may damage the tablet, battery and payment terminal.
- The Kiosk must be placed on a level, stable and dry surface and positioned so that it cannot fall over. The Customer must take into account the presence of children and the routes used by visitors.
- The Customer must use only the supplied or Sadaqah Kiosk-recommended power supplies, cables and charging equipment, and must position cables so that they do not create a tripping hazard.
- The Customer must not cover the Kiosk or charging equipment and must keep ventilation openings clear.
- In the event of visible damage, a damaged cable, moisture entering the device, an unusual smell or overheating, the Customer must immediately stop using the Kiosk, disconnect it from the power supply and contact Sadaqah Kiosk. The Customer must not use the Kiosk again until advised to do so.
- Sadaqah Kiosk does not guarantee that the Kiosk will be available or operational under all circumstances.
- Sadaqah Kiosk is not responsible for outages caused solely by, for example, internet providers, power failures, SumUp or other external services over which Sadaqah Kiosk has no control.
Article 12 — Software
- The software/application used with the Sadaqah Kiosk is maintained as an open-source project.
- Sadaqah Kiosk aims to investigate technical problems and reported bugs within reason and, where possible, resolve them.
- No guarantee is given regarding a particular frequency of updates, continued development or continued support for every version of the software.
- Sadaqah Kiosk is not obliged to modify the functionality of the software at the request of an individual Customer.
- The above does not affect any statutory obligations relating to a supplied service or product.
Article 13 — Faults and Technical Support
- In the event of a fault, the Customer should first check:
- whether the internet connection is working;
- whether Bluetooth is enabled and working correctly;
- whether the Kiosk is connected to mains power; and
- whether the other equipment is connected correctly.
- If the problem is not resolved by these checks, the Customer may contact Sadaqah Kiosk via sadaqahkiosk@gmail.com.
- If a software error is reported, Sadaqah Kiosk will try to investigate the problem and, where reasonably possible, resolve it.
- Sadaqah Kiosk does not provide an uptime guarantee.
Article 14 — Withdrawal and Cancellation
- Each Kiosk is manufactured according to the Customer's specifications and fitted with a Design Panel manufactured exclusively for that Customer. For goods made to a Customer's specifications, there is no statutory right of withdrawal under the law.
- Despite this, Sadaqah Kiosk grants Consumers the right to withdraw from the Agreement without giving a reason within fourteen days from the day on which the Consumer, or a third party designated by the Consumer, received the Kiosk. This right is granted subject to the conditions stated in this article.
- The Consumer may exercise the right of withdrawal by sending an unequivocal statement to sadaqahkiosk@gmail.com within that period. Use of a model withdrawal form is permitted but not required.
- After withdrawal, the Consumer must return the Kiosk carefully and adequately protected within fourteen days. The return shipping costs are borne by the Consumer.
- In the event of withdrawal, the purchase price will be refunded less a fixed amount of €40 for the design and Design Panel. The Design Panel is manufactured exclusively for that Customer and cannot be reused.
- This €40 amount is a fixed fee for producing the design and Design Panel. The amount will not be increased based on the size or complexity of the design.
- Sadaqah Kiosk will refund the amount due within fourteen days after receiving the withdrawal, and after receiving the Kiosk back, or after the Consumer has demonstrated that the Kiosk has been sent.
- An order may be cancelled free of charge as long as production has not yet started. Sadaqah Kiosk will confirm in writing when production starts.
- For business Customers and organisations that do not act as Consumers, there is no statutory right of withdrawal. If such Customers cancel after production has started, Sadaqah Kiosk may charge the €40 fee referred to in paragraph 5. This amount will not be charged in addition to other cancellation costs.
- Nothing in this article limits any rights that a Consumer has under mandatory law.
Article 15 — Returns
- A return other than under the right of withdrawal or warranty must be agreed with Sadaqah Kiosk in advance.
- The Customer must return the Kiosk or component carefully and adequately protected.
- In the event of a warranty claim or statutory conformity claim, shipping costs are borne by Sadaqah Kiosk, as stated in Article 9.
- In the event of withdrawal by a Consumer, return shipping costs are borne by the Consumer and the purchase price will be refunded less the €40 fee referred to in Article 14.
Article 16 — Privacy and Data
- Sadaqah Kiosk processes personal data and other data as described in the separate Privacy Policy.
- The Customer can consult the Privacy Policy for information about, among other things:
- which personal data are processed;
- the purposes for which they are processed;
- the legal bases;
- retention periods;
- recipients and processors;
- the rights of data subjects; and
- how privacy requests can be submitted.
- Sadaqah Kiosk aims to process only data that are necessary for the relevant purpose and to apply appropriate technical and organisational security measures.
Article 17 — Kiosk and Donation Data
- If the software and infrastructure are configured for this purpose, Sadaqah Kiosk may process technical and statistical data from Kiosks.
- This may include:
- the date and time of a donation;
- the amount donated;
- the Kiosk identification number;
- technical error messages;
- connection information;
- status information required for maintenance and troubleshooting.
- The Kiosk is not intended to collect personal data from donors. Sadaqah Kiosk does not receive a donor's name, email address, telephone number or card number through the Kiosk.
- Sadaqah Kiosk does not receive personal data of donors from SumUp.
- Kiosk IDs may be linked internally to the relevant Customer or masjid to enable maintenance, support and statistics.
- Data may be used for maintenance, technical support, statistics, product improvement and marketing.
- Data relating to individual masjids or organisations will not be published as individual donation figures. Aggregated figures, such as the total amount donated across all Kiosks combined, may be used or published.
- The precise processing, retention periods and rights of data subjects are described in more detail in the Privacy Policy.
Article 18 — Intellectual Property
- All intellectual property rights in designs, software, texts, images, trade names and other materials developed by Sadaqah Kiosk remain with Sadaqah Kiosk or the relevant rights holder, unless otherwise agreed in writing.
- The Kiosk design referred to in Article 6 and the materials supplied by the Customer are an exception to this: these remain the property of the Customer, subject to the right of use granted in Article 6.
- The Customer obtains only those rights that are necessary for normal use of the supplied Kiosk.
- The Customer is not permitted to commercially copy, distribute or offer as their own product any part of the standard design, software or other materials of Sadaqah Kiosk, unless permitted by law or agreed in writing.
- Separate open-source licence terms may apply to open-source software. Where applicable, those licence terms take precedence for the use of that software.
Article 19 — Liability
- Sadaqah Kiosk is only liable for direct damage resulting from an attributable failure to perform, insofar as liability cannot be excluded under the law.
- To the extent permitted by law, Sadaqah Kiosk is not liable for damage arising from:
- outages at SumUp;
- internet or power failures;
- outages at external service providers;
- incorrect or careless use of the Kiosk;
- insufficient maintenance;
- unsuitable or unsafe placement;
- modifications to the Kiosk by the Customer or third parties;
- third-party software or equipment; or
- circumstances beyond the reasonable control of Sadaqah Kiosk.
- Sadaqah Kiosk is not responsible for the amount of donations received through a Kiosk and does not guarantee any level of revenue from the Kiosk.
- Sadaqah Kiosk does not guarantee that every individual donation can be processed successfully.
- Nothing in these Terms & Conditions limits liability to the extent that such limitation is not permitted by law.
- Consumers always retain the statutory protection that cannot be excluded or limited by contract.
Article 20 — Force Majeure
- Sadaqah Kiosk is not obliged to fulfil an obligation if fulfilment is temporarily or permanently impossible due to a circumstance that cannot reasonably be attributed to Sadaqah Kiosk.
- Force majeure may include, among other things: outages at suppliers or service providers, internet failures, power failures, transport problems, illness, fire, government measures, extreme weather conditions, war, pandemics and other circumstances beyond the reasonable control of Sadaqah Kiosk.
- If force majeure occurs, Sadaqah Kiosk will inform the Customer as soon as reasonably possible.
- If performance becomes permanently impossible due to force majeure, either party may terminate the Agreement. Amounts already paid for products that have not been delivered will then be refunded.
Article 21 — Complaints
- Complaints about a supplied Kiosk, invoice or service can be submitted via sadaqahkiosk@gmail.com.
- The Customer is requested to describe the complaint as clearly as possible and, where relevant, provide photographs or other information about the problem.
- Sadaqah Kiosk will confirm receipt of a complaint within fourteen days and will try to reach an appropriate solution together with the Customer.
- Consumers retain their statutory rights relating to complaints and defects.
Article 22 — Disputes
- Sadaqah Kiosk and the Customer will first attempt to resolve a dispute through mutual consultation.
- The party identifying a dispute should preferably contact the other party first in an attempt to reach a solution.
- If the parties cannot resolve the matter between themselves, the dispute may be submitted to the competent Dutch court.
- Agreements between Sadaqah Kiosk and the Customer are governed by Dutch law.
- If the Customer is a Consumer, mandatory rules providing consumer protection remain applicable, even where these rules result in a different competent court or the application of different rules.
Article 23 — Amendments to the Terms & Conditions
- Sadaqah Kiosk may amend these Terms & Conditions where this is necessary due to changes in legislation, a changed product or a changed business operation.
- For Agreements already concluded, the Terms & Conditions applicable at the time the Agreement was formed will continue to apply, unless an amendment is permitted under the law or the Agreement.
- A new version of the Terms & Conditions will be published on the website.
Article 24 — Final Provisions
- If any provision of these Terms & Conditions proves to be void, invalid or unenforceable, the remaining provisions will remain fully in force.
- In that case, the parties will attempt to replace the relevant provision with a legally valid provision that corresponds as closely as possible to its original purpose.
- These Terms & Conditions are drafted in Dutch. If Sadaqah Kiosk also provides an English translation, the Dutch version shall be the basis for interpretation, unless mandatory consumer law provides otherwise.
